Sherrard, German & Kelly’s Real Estate Group provides comprehensive legal services to real estate developers, commercial banks, corporate clients, investors and entrepreneurs. We advise clients on the full range of project management and procurement issues, their documentation and tax implications. We are particularly skilled at risk management and dispute resolution including adjudication and litigation, as well as all forms of alternative dispute resolution including arbitration and mediation.
Our Real Estate Services Group has the experience and market knowledge to help clients navigate the world of dense leasing documents, construction and development issues and interactions with leasing brokers. We advise landlords and tenants in all aspects of lease negotiation for retail, office and industrial projects. We also advise investors, developers, property managers and agents concerning operational and management issues, often structuring arrangements for the management and leasing of major commercial developments. Our Real Estate Group also has extensive experience advising corporate clients in connection with asset sales, mergers and acquisitions where the successful transfer of leasehold interests (often in multiple locations) is critical.
Zoning and Land Use / Tax Assessment Appeals
We help property owners and developers obtain necessary planning and zoning approvals, changes and permits, including representing clients in appeals before municipal zoning hearing boards and trial and appellate courts. We are familiar with state and local requirements and procedures throughout western Pennsylvania. We are also experienced in pursuing tax assessment appeals for both commercial and residential property owners, and have argued before numerous appellate courts in Pennsylvania. When a property owner wants to take legal action to appeal the assessment of their property, we can guide them through the litigation process.
We regularly assist clients with financing real estate projects such as acquisition, development and construction loans. We represent banks and investors in the financing of commercial, industrial and residential projects, from multi-property, cross-collateralized financings to more traditional single-asset mortgage financings. Our experience in representing sophisticated lenders and developers provides us with the proper tools to structure and effectively implement many forms of financing transactions.
Residential Transactions / Title Insurance
In addition to its extensive commercial real estate practice, our Real Estate Services Group boasts an experienced residential real estate practice. Our lawyers work closely with several lending institutions on residential transactions. Our practice in the residential arena is strengthened by the fact that Sherrard, German & Kelly is an authorized agent for a number of title insurance companies. As an agent, we can conduct title searches and issue title insurance policies for a variety of residential (as well as commercial) transactions.
